1. Overview and Acceptance
Welcome to AIberia Tech. Our purpose is to free SME owners from daily operations so they can focus on growth and strategy. By hiring our services or using our website, you agree to be legally bound by these terms and conditions in their entirety.
2. Description of Services
AIberia Tech does not sell technology, but measurable results and peace of mind. Our services focus on implementing systems that work for you. This includes, among others:
- Automated Communication and Sales Systems: Implementation of solutions (such as intelligent assistants, automation processes, etc.) to manage customer communication, capture sales opportunities, and schedule appointments 24/7, ensuring no business opportunity is missed.
- Operations and Marketing Optimization: Automation of internal processes, workflows, and marketing campaigns to reduce manual workload, eliminate errors, and increase operational efficiency and brand impact.
- Strategic Growth Consulting: Analysis of your business to identify the highest-impact opportunities for automation, designing a clear roadmap to transform your operations and facilitate growth.
3. Our Collaboration and Billing Process
Our relationship is based on transparency and value. The process is designed to align our objectives with yours from the very beginning:
- Diagnosis and Value Proposition: We analyze your processes to identify the areas of greatest impact. We present a detailed proposal that defines the scope, measurable objectives (KPIs), the implementation project cost, and estimated delivery timelines.
- Acceptance and Kickoff: To start the project, acceptance of the proposal and payment of a setup and implementation fee is required. This initial payment formalizes our collaboration and allows us to allocate the necessary resources to build your solution.
- Delivery, Verification, and Activation: Once the solution is implemented, we verify it together with you to ensure it meets the agreed objectives. After your validation, the final project invoice is issued and the monthly support and maintenance plan is activated, if applicable.
4. Right of Withdrawal
If you are a consumer, you have the right to withdraw from the contract within 14 calendar days without the need to justify your decision, counted from the date of service engagement.
Exceptions: The right of withdrawal does not apply when the service has been fully performed or when it involves personalized services that have begun execution with your express consent.
To exercise this right, you must notify us of your decision by email to info@aiberiatech.com. In case of valid withdrawal, we will return all payments received without undue delay and, in any case, within 14 calendar days from the date we were informed of your decision.
5. Client Obligations
To ensure the success of the collaboration, the Client commits to providing the necessary information and access in a timely manner for the analysis and implementation of the solutions. The Client is responsible for the accuracy of the information provided and for using the services lawfully and in accordance with current regulations.
6. Cancellation and Refunds
One-time services (implementations): Once the project has started, cancellation by the Client will result in proportional billing for work already completed.
Recurring services (maintenance): Can be cancelled with 30 days' notice. No partial refunds will be made for the current month.
We reserve the right to suspend or cancel the service in case of non-payment, misuse, or breach of these terms, with 15 days' prior notice.
7. Intellectual Property
The content, methodologies, and software on our website are the property of AIberia Tech. Custom automation solutions developed for the Client, once the service is fully paid, will be the property of the Client, although AIberia Tech may reuse non-specific knowledge and base components for other projects.
8. Warranties and Limitation of Liability
Warranties: We guarantee that our services will be provided with professional diligence and in accordance with the agreed specifications. For implementation services, we offer 30 days of warranty against operational defects from delivery.
Limitation of liability: Our liability is limited to the correct implementation and operation of the agreed services. We shall not be liable for indirect damages, loss of profit, or data losses that are not a direct consequence of a serious breach of our obligations.
Our maximum financial liability for any claim shall be limited to the total amount paid for the service in question in the last six months, except in cases of willful misconduct or gross negligence.
9. Confidentiality
Both parties commit to maintaining the strictest confidentiality regarding the sensitive business information of the other party to which they may have access during the provision of the service. This commitment shall be maintained even after the end of the business relationship.
10. Force Majeure
We shall not be liable for the failure or delay in the performance of our obligations when caused by force majeure, including but not limited to: natural disasters, strikes, failures of third-party essential service providers, internet or power outages, or any other extraordinary and unforeseeable circumstance beyond our control.
11. Dispute Resolution
In case of conflict, both parties commit to attempting to resolve it through direct negotiation. If not possible, we will resort to mediation through the official mediation institutions of the Valencian Community.
As a last resort, any dispute shall be resolved in the courts of Valencia, with Spanish law being applicable.
12. Amendments and Severability
We reserve the right to modify these Terms, notifying such changes to our active clients with at least 30 days' notice. Continued use of our services after notification shall constitute acceptance of the new terms.
If any provision of these terms is declared null or unenforceable by a competent court, the remaining provisions shall continue in full force and effect.
